General Terms and Conditions

1. Scope

The following terms and conditions apply to all orders placed through our online shop. Our online shop is exclusively aimed at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.

2. Contract Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with mySoundbook UG.

By adding products to the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded by clicking the order button to accept the offer for the goods contained in the shopping cart. Immediately after submitting the order, you will receive a confirmation by email.You will receive a confirmation by email once again after placing the order.

3. Contract language, contract text storage

The language available for the conclusion of the contract is German.

We store the contract text and send you the order data and our terms and conditions in text form. You can view the contract text in our customer login.

4. Delivery conditions

In addition to the stated product prices, shipping costs will be added. You can find out more about the amount of shipping costs in the offers.

We have the right to fulfill the contract within 14 days. In case of cancellation within the 14 days, we will charge you a cancellation fee of 20%. This is to avoid new goods being used as test goods.

We only deliver by shipping. Unfortunately, self-pickup of the goods is not possible.

5. Payment

In our shop, the following payment methods are generally available to you:

Prepayment
If you select the payment method prepayment, we will provide you with our bank details in a separate email and deliver the goods after payment has been received.

Credit card
By placing the order, you provide your credit card details. After your authentication as the rightful cardholder, the payment transaction will be processed automatically and your card will be charged.

PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate with your login details, and confirm the payment instruction to us. After placing the order in the shop, we instruct PayPal to initiate the payment transaction. The payment transaction will then be processed automatically by PayPal. You will receive further information during the ordering process.

PayPal Plus
As part of the PayPal Plus payment service, we offer you various payment methods as PayPal services. You will be redirected to the website of the online provider PayPal. There, you can provide your payment details, confirm the use of your data by PayPal, and authorize the payment instruction to PayPal.

If you chose the payment method PayPal you need to be registered there or register first and authenticate with your login details to pay the invoice amount. The payment transaction will be carried out automatically by PayPal immediately after confirmation of the payment instruction. You will receive further instructions during the ordering process.

Credit card via PayPal
If you chose the credit card payment method, you don't need to be registered with PayPal to pay the invoice amount. The payment transaction will be carried out immediately after confirmation of the payment instruction and after your authentication as the rightful cardholder by your credit card company at the request of PayPal, and your card will be charged. You will receive further instructions during the ordering process.

Direct debit via PayPal
If you chose the payment method direct debit, you don’t need to be registered with PayPal to pay the invoice amount. By confirming the payment order, you give PayPal a direct debit mandate. PayPal will inform you of the date of the debit (so-called prenotification). By submitting the direct debit mandate immediately after confirming the payment order, PayPal instructs its bank to initiate the payment transaction. The payment transaction is carried out, and your account is charged.You will receive further information during the ordering process.

Invoice via PayPal
If you chose the payment method invoice, you do not have to be registered with PayPal to pay the invoice amount. After successfully verifying your address and creditworthiness and placing your order, we assign our claim to PayPal. In this case, you can only make payments to PayPal with discharging effect. The terms and conditions of PayPal apply to the payment processing via PayPal, in addition to our terms and conditions. 6. Transport damages

If goods are delivered with obvious transport damages, please report such errors immediately to the carrier and contact us without delay. Failing to make a complaint or contact has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

7. Warranty and guarantees

Unless expressly agreed otherwise below, the statutory liability for defects applies.
For used goods, if the defect occurs after one year from delivery of the goods, the claims for defects are excluded. Defects that occur within one year from delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods.
The above restrictions and time limits do not apply to claims for damages caused by us, our legal representatives, or agents.
• in case of injury to life, body, or health
• in case of intentional or grossly negligent breach of duty as well as deceit
• in case of violation of essential contractual obligations, the fulfillment of which enables the proper execution of the contract and on which the contractual partner can regularly rely (cardinal obligations)
• as part of a warranty promise, as agreed or
• as far as the scope of the Product Liability Act is opened.

8. Exchange

Excluded from exchange are:

9. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR) that you here can find. We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
